Terms and Conditions

This ‘Terms and Conditions’ document (“T&C”) governs the end users’ (“You/Your/User”) access to and use of ‘Synergy Interactive Productions LLP’ (which term shall be deemed to include the internet and mobile website https://ulteriormotive.in as well as its mobile application and any other means to access the same from time to time) and the services offered thereunder.

The https://ulteriormotive.in is owned and controlled by Synergy Interactive Productions LLP (hereinafter referred to as “Synergy Interactive Productions LLP/Us/Our/We“). Through Synergy Interactive Productions LLP, we provide to You information in relation to events & music made by us.

This T&C, along with the ‘Privacy Policy’ (available here) which constitutes an integral and inalienable part of the T&C, and any other applicable policies published on the Synergy Interactive Productions LLP platform, comprise a binding agreement between You and Synergy Interactive Productions LLP. The ‘T&C’, ‘Privacy Policy’ and any such applicable policies constitute an electronic record under the Information Technology Act, 2000 as amended and the relevant rules made thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes under applicable Indian laws.

Your use of the Synergy Interactive Productions LLP platform and the services provided thereunder shall be governed by this T&C as well as any other applicable policies published on Synergy Interactive Productions LLP, including but not limited to the Privacy Policy. Your use of the Synergy Interactive Productions LLP platform, whether for the purpose of transacting through Synergy Interactive Productions LLP or otherwise, implies Your consent to the provisions of this T&C as well as any other applicable policies, use of any information provided by You for the purpose of Your use of Synergy Interactive Productions LLP. Synergy Interactive Productions LLP hereby reserves the right to modify, add, or delete any part of this T&C without any prior written notice/intimation to You. It shall be Your sole responsibility to periodically review this T&C and all other applicable policies published on Synergy Interactive Productions LLP for any revisions thereto. If You do not agree to any of the revisions made to this T&C by Synergy Interactive Productions LLP, You must discontinue further access and use of the platform and the services provided thereunder. You agree and acknowledge that such discontinuance of access to and use of Synergy Interactive Productions LLP and the services provided thereunder will render the T&C inapplicable from such date of discontinuance only; however, this T&C will remain applicable to all instances of use by You of Synergy Interactive Productions LLP and the services provided thereunder prior to such date of discontinuance.

It is clarified that terms and conditions specific to an event in respect of which Synergy Interactive Productions LLP has facilitated the sale of tickets through the platform (“Event”) shall be published on the event page accessible on Synergy Interactive Productions LLP. Synergy Interactive Productions LLP publishes such information as provided by and on behalf of the organizer associated with such Event (Event Organizer). In the event of any conflict between the Event-related terms and conditions, and this T&C, User agrees that the Event-related terms and conditions shall prevail and be binding on the User at all times.

Cancellation Protect

In case of cancellation for bookings with cancellation protect in relation to an Event (as applicable), the User will be entitled to a refund of 100% of the ticket price within the cancellation window.
A cancellation protected booking has a window of up to 10 days prior to the Event or the date of courier, whichever is earlier, for canceling the booking.
Tickets purchased online on Synergy Interactive Productions LLP cannot be canceled via an offline mode either being the box-office or stores.
Cancellation Protect only covers the ticket and food and beverages booked; any additional amount like commission, convenience fees & cancellation protect fees including GST on the same will not be refunded.
Partial cancellation of a booking is not allowed.
Refund will be processed to the source account used for payment at the time of booking.
On any booking with cancellation protect, the User will receive a booking confirmation via SMS/email. Please note that the booking confirmation is NOT the ticket, and the User would be able to enter the Event arena only with physical tickets or an e-ticket, in accordance with the terms and conditions of the Event in respect of which the User has booked a ticket. In the event that entry is subject to the presentation of physical tickets by the User, the said physical tickets will be delivered once the allowed cancellation period is over.
Synergy Interactive Productions LLP reserves the right to alter the terms and conditions or discontinue the offer without prior notice. Synergy Interactive Productions LLP may suspend any User’s ability to participate in the said program at its discretion without prior intimation and reasoning.
In case of any issues, the decision of Synergy Interactive Productions LLP will be considered final and binding on the User(s) at all times.

Copyright

The entire content included in Synergy Interactive Productions LLP, including but not limited to text, graphics, or code, is copyrighted as a collective work under the Indian and all other copyright laws of the world, and is the sole property of Synergy Interactive Productions LLP or is appropriately licensed by Synergy Interactive Productions LLP from the relevant owners thereof. At no point in time will the User have any rights and/or claim to have acquired any rights in and to any part or portion of Synergy Interactive Productions LLP and/or any content contained therein, in any manner whatsoever.

You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from different areas of Synergy Interactive Productions LLP solely for Your own non-commercial use or to place an order with Synergy Interactive Productions LLP or to purchase products from the platform.

Any other use, including but not limited to the reproduction, distribution, display, or transmission of the content of Synergy Interactive Productions LLP, is strictly prohibited unless specifically authorized by Synergy Interactive Productions LLP in writing.

Trademarks

All trademarks, service marks, and trade names of ‘Synergy Interactive Productions LLP’ used on the platform are trademarks or registered trademarks of Synergy Interactive Productions LLP. At no point in time will the User have any rights and/or claim to have acquired any rights in and to any part or portion of the ‘Synergy Interactive Productions LLP’ trademarks and/or logos, in any manner whatsoever.

Limited User

The User agrees and undertakes not to sell, trade, resell, or exploit for any commercial purposes, any portion of the service. For the removal of doubt, it is clarified that Synergy Interactive Productions LLP is not for commercial use but is specifically meant for personal use only.

The User further agrees and undertakes not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from Synergy Interactive Productions LLP. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes, and unwarranted modification of data and information within the content of Synergy Interactive Productions LLP is not permitted.

Disclaimer of Warranties/Limitation of Liability

Synergy Interactive Productions LLP has endeavored to ensure that all the information on the website is correct, but Synergy Interactive Productions LLP neither warrants nor makes any representations regarding the quality, accuracy, or completeness of any data or information contained. Synergy Interactive Productions LLP makes no warranty, express or implied, concerning the website and/or its contents and disclaims all warranties of fitness for a particular purpose and warranties of merchantability in respect of services, including any liability, responsibility, or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any user or any other person, arising out of or from the use of the information contained in the website.

Since Synergy Interactive Productions LLP acts only as a booking agent, it shall not have any liability whatsoever for any aspect of the arrangements between the service provider and the user as regards the standards of services provided by the service providers. In no circumstances shall Synergy Interactive Productions LLP be liable for the services provided by the service provider.

Although Synergy Interactive Productions LLP makes reasonable commercial efforts to ensure that the description and content in the T&C and on each page of the website is correct, it does not, however, take responsibility for changes that occurred due to human or data entry errors or for any loss or damages suffered by any user due to any information contained herein. Also, Synergy Interactive Productions LLP is not the service provider and therefore cannot control or prevent changes in the published descriptions which are based upon information provided by service providers.

Synergy Interactive Productions LLP does not endorse any advertiser on its website in any manner. The users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

In no event shall Synergy Interactive Productions LLP be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages resulting from: (a) the use or the inability to use the services; (b) the cost of procurement of substitute goods and services or resulting from any goods, information, or services purchased or obtained or messages received or transactions entered into through the services; (c) unauthorized access to or alteration of the user’s transmissions or data; (d) any other matter relating to the services, including, without limitation, damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the website. Neither shall Synergy Interactive Productions LLP be responsible for the delay or inability to use the website or related services, the provision of or failure to provide services, or for any information, software, products, services, and related graphics obtained through the website, or otherwise arising out of the use of the website, whether based on contract, tort, negligence, strict liability, or otherwise. Further, Synergy Interactive Productions LLP shall not be held responsible for non-availability of the website during periodic maintenance operations or any unplanned suspension of access to the website that may occur due to technical reasons or for any reason beyond Synergy Interactive Productions LLP’s control. The user understands and agrees that any material and/or data downloaded or otherwise obtained through the website is done entirely at their own discretion and risk, and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data. These limitations, disclaimers of warranties, and exclusions apply without regard to whether the damages arise from (a) breach of contract, (b) breach of warranty, (c) negligence, or (d) any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law. The maximum liability on the part of Synergy Interactive Productions LLP arising under any circumstances, in respect of any services offered on the site, shall be limited to the refund of the total amount received from the customer for availing the services less any cancellation, refund, or other charges, as may be applicable. In no case shall the liability include any consequential loss, damage, or additional expense whatsoever.

Prohibition Against Unlawful Use

As a condition of the use of the Website, the User warrants that they will not use the Website for any purpose that is unlawful or illegal under any law for the time being in force within or outside India or prohibited by this Agreement and/or the T&C, including both specific and implied. In addition, Synergy Interactive Productions LLP’s Website shall not be used in any manner that could damage, disable, overburden, or impair it or interfere with any other party’s use and/or enjoyment of the Website. The User shall refrain from obtaining or attempting to obtain any materials or information through any means not intentionally made available or provided for or through Synergy Interactive Productions LLP.

User’s Obligation and User Account

In consideration of use of the Website, the User represents and confirms that the User is of legal age to enter into a binding contract and is not a person barred from using the Website and/or receiving the Services under the laws of India or other applicable law.

To avail a Service, the User has and must continue to maintain at his sole cost: (a) all the necessary equipment including a computer and modem, etc. to access the Website/avail Services; (b) own access to the World Wide Web. The User shall be responsible for accessing the Services, and that access may involve third-party fees including airtime charges or internet service providers’ charges, which are to be exclusively borne by the User.

The User also understands that the services may include certain communications from Synergy Interactive Productions LLP as service announcements and administrative messages. The User understands and agrees that the services are provided on an “as is” basis and that Synergy Interactive Productions LLP does not assume any responsibility for deletions, mis-delivery, or failure to store any user communications or personalized settings.

Registration of the User on the Website is optional. If the User opts to register him/herself on the Website, upon completion of the registration process, the User shall receive a user ID and password. The User agrees and undertakes at all times to be responsible for maintaining the confidentiality of the password and user ID and shall be fully responsible for all activities that occur by use of such password or user ID. Further, the User agrees not to use any other party’s user ID and password for any purpose whatsoever without proper authorization from such party. The User is responsible for the security of their password and for all transactions undertaken using their password through our service. The password entered by the User is transmitted in one-way encrypted form to our database and stored as such. Thus, the password will not be known even to Synergy Interactive Productions LLP. The User confirms that they are the authorized holder of the credit card or the original account holder used in the transactions made using the Synergy Interactive Productions LLP services. Synergy Interactive Productions LLP will not be responsible for any financial loss, inconvenience, or mental agony resulting from misuse of the User’s ID/password/credit card number/account details for using Synergy Interactive Productions LLP services.

The User also agrees and undertakes to immediately notify Synergy Interactive Productions LLP of any unauthorized use of the User’s password or user ID and to ensure that the User logs off at the end of each session on the website. Synergy Interactive Productions LLP shall not be responsible for any direct or indirect loss or damage arising out of the User’s failure to comply with this requirement.

The User also agrees to: (a) provide true, accurate, and complete information about him/herself and his/her beneficiaries as prompted by the registration form (“Registration Data”) on the Website; and (b) maintain and promptly update the Registration Data to keep it true, accurate, current, and complete. If the User provides any information that is untrue, inaccurate, not current, or incomplete or if Synergy Interactive Productions LLP has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, Synergy Interactive Productions LLP has the right to suspend or terminate the User’s registration and refuse any and all current or future use of the Website and/or any Service.

Furthermore, the User grants Synergy Interactive Productions LLP the right to disclose to third parties Registration Data to the extent necessary for the purpose of carrying out the Services.

Breach

Without prejudice to the other remedies available to Synergy Interactive Productions LLP under this agreement, the T&C, or under applicable law, Synergy Interactive Productions LLP may limit the User’s activity, end the User’s listing, warn other users of the User’s actions, immediately temporarily/indefinitely suspend or terminate the User’s registration, and/or refuse to provide the User with access to the website if:

(a) the User is in breach of this agreement, the T&C, and/or the documents it incorporates by reference;

(b) Synergy Interactive Productions LLP is unable to verify or authenticate any information provided by the User; or

(c) Synergy Interactive Productions LLP believes that the User’s actions may infringe on any third-party rights or breach any applicable law or otherwise result in any liability for the User, other users of the website, and/or Synergy Interactive Productions LLP.

Synergy Interactive Productions LLP may at any time in its sole discretion reinstate suspended users. Once the User has been indefinitely suspended, the User may not register or attempt to register with Synergy Interactive Productions LLP or use the website in any manner whatsoever until such time that the User is reinstated by Synergy Interactive Productions LLP. Notwithstanding the foregoing, if the User breaches this agreement, the T&C, or the documents it incorporates by reference, Synergy Interactive Productions LLP reserves the right to recover any amounts due and owing by the User to Synergy Interactive Productions LLP and/or the service provider and to take strict legal action as Synergy Interactive Productions LLP deems necessary.

Termination of Agreement and Services

Either the User or Synergy Interactive Productions LLP may terminate this Agreement and a Service with or without cause at any time to be effective immediately.

The User agrees that Synergy Interactive Productions LLP may under certain circumstances and without prior notice, immediately terminate the User’s user ID and access to the Website/Services. Causes for termination may include, but shall not be limited to, breach by the User of this Agreement or the T&C, requests by enforcement or government agencies, requests by the User, or non-payment of fees owed by the User in connection with the Services as specified in the applicable T&C.

This Agreement may be terminated by either the User or Synergy Interactive Productions LLP through a written notice to the other. Synergy Interactive Productions LLP shall not be liable to the User or any third party for termination of any Service. Should the User object to any terms and conditions of this Agreement, any T&C, or become dissatisfied with the Service in any way, the User’s only recourse is to immediately: (a) discontinue use of the Website/Service; and (b) notify Synergy Interactive Productions LLP of such discontinuance.

Upon termination of the Service, the User’s right to use the Website/Services and software shall immediately cease. The User shall have no right and Synergy Interactive Productions LLP shall have no obligation thereafter to execute any of the User’s uncompleted tasks or forward any unread or unsent messages to the User or any third party. Once the User’s registration or the Services are terminated, canceled, or suspended, any data that the User has stored on the Website may not be retrieved later.

Notices

All notices and communications, including those related to changes in the T&C, Services, or termination thereof, shall be in writing in English. Notices will be deemed given if delivered personally, by commercial messenger, courier service, registered or certified mail (return receipt requested), or sent via email/facsimile (with acknowledgment of complete transmission) to the following addresses:

If to a non-registered User: the communication and/or email address specified at [email protected]
If to a registered User: the communication and/or email address specified in the registration form.

Notices sent via email shall be deemed served 48 hours after sending unless the sending party becomes aware that the email address is invalid.

Pricing, Availability, and Seat Confirmation

Synergy Interactive Productions LLP operates as a ticketing platform, selling tickets on behalf of Event Organisers and therefore does not control availability and pricing.

Upon successful payment, Users will receive a confirmation page or email, which must be presented at the event venue to redeem tickets.

If Users do not receive a confirmation number or experience an error message after payment, they should contact customer service to verify the order status to avoid financial loss.

While purchasing tickets, Users are limited to a specific number of tickets per event.

Censor Warning

Users are advised to check the censor warning before purchasing tickets. Children under the age of 18 will not be allowed entry, and additional ratings or entry restrictions may apply to certain events.

Fees & Purchase Terms

Synergy Interactive Productions LLP may charge service fees for buying and/or selling tickets through its Services, as well as delivery or fulfillment fees. The Service Fees and billing methods are subject to change at any time. Synergy Interactive Productions LLP reserves the right to retain Service Fees if the User does not fulfill their obligations or if the Event is cancelled.

Users must provide a valid credit card (Visa, MasterCard, or any other accepted issuer) as a condition for signing up for Services. By providing payment information, Users authorize Synergy Interactive Productions LLP to invoice their account for all fees and charges due. Users agree to notify Synergy Interactive Productions LLP of any changes in billing information immediately.

Taxes

Service Fees do not include applicable Sales Tax. If any Services or payments for Services are subject to Sales Tax in any jurisdiction, Users are responsible for paying such taxes and related penalties or interest. Users will indemnify Synergy Interactive Productions LLP for any liability, penalties, interest, or expenses related to Sales Taxes.

Cancellations, Exchanges and Refunds

Tickets: Once sold, tickets cannot be exchanged, cancelled, or refunded. Users should check the event details before booking tickets. If an Event is cancelled or postponed and the Event Organisers agree to issue refunds, it is the sole responsibility of the Event Organisers to contact Users and process refunds. Synergy Interactive Productions LLP is not liable for other event changes, such as partial performances, venue changes, or time changes; no refunds will be issued in these cases.

Disputes

Users must notify Synergy Interactive Productions LLP in writing within seven (7) days after receiving their credit card statement if there are any disputes regarding charges. Disputes should be sent to: [email protected]

Buyer Beware

Users should carefully read the Terms and Conditions. Accepting the Terms while booking a ticket online constitutes a valid contract between the User and Synergy Interactive Productions LLP.
Booking IDs generated through the website are considered valid.
Ensure all personal and payment details are accurate; Booking IDs cannot be cancelled, refunded, or exchanged once generated.
Keep Booking IDs secure and do not share them. Anyone in possession of a Booking ID is entitled to exchange it for a valid ticket without further security checks.
Do not engage with individuals selling printouts or SMS of Booking IDs generated by Synergy Interactive Productions LLP. Report any suspicious activity to local authorities and Synergy Interactive Productions LLP at [email protected].
Synergy Interactive Productions LLP will not sell tickets above the prices listed on the website.
Synergy Interactive Productions LLP will never request Personal Identification Number (PIN) details through any means other than the transaction page on the website during online booking.
Report any unauthorized attempts to sell special offers, vouchers, or Booking IDs to [email protected].

Booking IDs generated by Synergy Interactive Productions LLP entitle the holder to exchange them for a valid ticket but do not constitute a valid ticket in themselves. Users are responsible for ensuring that the holder is the rightful owner of the Booking ID and should not compromise or misuse it.
